Terms of Service

Welcome to Hueband. These Terms of Service ("Terms") govern your use of the Hueband mobile app and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EEA / UK) to use Hueband. By using the Service you confirm you meet this requirement and that all information you provide is accurate.

2. Your account

You sign in with Apple or Google. You are responsible for the security of the underlying account and for all activity that happens under your Hueband account. Let us know right away if you suspect unauthorized access.

3. Couple pairing & shared content

Hueband is designed for two people to share mood updates with each other. When you pair with a partner, the moods, custom moods, and reactions you record become visible to that partner. Only pair with someone you trust.

You can unpair at any time in Settings. Unpairing removes you from the shared couple, but your partner retains the copy of moods that were already synced to their device.

4. Hueband Pro subscriptions

Hueband offers an optional paid subscription, Hueband Pro, that unlocks additional features such as unlimited custom moods and full mood history.

• Billing. Subscriptions are sold through the Apple App Store or Google Play and are billed to the account tied to that store.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the renewal date.
• Managing & cancelling. You can manage or cancel your subscription any time in your Apple ID Subscriptions settings or Google Play Subscriptions. Cancellation takes effect at the end of the current billing period.
• Refunds. Refunds are handled by Apple or Google under their respective policies. We generally cannot issue refunds directly.
• Price changes. If we change the subscription price, we'll give you notice before the change takes effect. Continued use after the change means you accept the new price.
• Free trials. If a free trial is offered, any unused portion is forfeited when you start a paid subscription.

5. Acceptable use

You agree not to:

• Use Hueband to harass, threaten, or harm another person
• Attempt to access, probe, or scrape accounts or data that don't belong to you
• Reverse-engineer, decompile, or tamper with the app beyond what the law allows
• Use the Service to violate any applicable law

We may suspend or terminate accounts that violate these rules.

6. Your content

You own the mood content you create. By using the Service, you grant us a limited, worldwide, royalty-free license to store, transmit, and display that content solely to operate the Service for you and your paired partner. We do not sell your content and we do not use it to train AI models.

7. Service availability

We work hard to keep Hueband running, but we don't guarantee uninterrupted or error-free service. Features may change, be added, or be removed over time.

8. Disclaimer

Hueband is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law. Hueband is a consumer wellness product. It is not a medical device, therapy, or substitute for professional mental-health care. If you or your partner are in crisis, please contact a qualified professional or local emergency services.

9. Limitation of liability

To the fullest extent permitted by law, Hueband and its developers will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $25.

10. Termination

You can stop using Hueband any time and delete your account from Settings → Delete Account & Data. We may suspend or terminate accounts for violations of these Terms or to protect the Service.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which the Service is operated, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless applicable consumer-protection law gives you the right to bring a claim where you live.

12. Changes to these Terms

We may update these Terms from time to time. If we make a meaningful change, we'll update the effective date above and surface the change in-app before it takes effect. Continued use after that means you accept the updated Terms.
